PROCEEDINGS: All parties presented before the court for a scheduled motion hearing on the
referred pending combined motion and memorandum for stay on discovery relating to extracontractual claims, or in the alternative, motion for protective order filed by the plaintiffs.
The Court questions the parties and heard argument from the parties.
The Court will allow the defendant’s to take the depositions of Stacey Jennings, Gary Noland
and Kevin Levy and the plaintiff’s to take the depositions of Ms. Black.
For reasons stated on the record and in open court, the Court denied the stay on discovery and
the alternative request for a protective order.
The Court cautioned the parties about making blanket discovery request, referenced what, why
and if they can’t why questions and, if any issues come up during depositions that can’t be
resolved, the parties are to call chambers. The parties are to streamline and narrow their focus.
