THE AMERICAN BAR ASSOCIATION, Defendant. ) ) Case No. 3:11-CV-608 ) ) ) Judge Varlan ) Magistrate Judge Shirley ) ) ) ) PLAINTIFF LINCOLN MEMORIAL UNIVERSITY DUNCAN SCHOOL OF LAW’S STATUS REPORT Pursuant to the Court’s Order of May 9, 2012 (Doc. 59), Defendant American Bar Association (the “ABA”) submitted a status report regarding the decision by the Council of the ABA Section of Legal Education and Admissions to the Bar (the “Section”) following the remand by the Appeals Panel (the “Panel”) of certain issues in connection with the application for provisional approval filed by the Plaintiff Lincoln Memorial University Duncan School of Law (the “School”). It is believed that the Section did not follow the instructions pursuant to the remand by the Panel. Inasmuch as this Court required an exhaustion of administrative remedies, the School feels it must appeal this matter back to the Panel in order to insure that the administrative remedies and this Court’s directive are complete. It is agreed that inasmuch as the Council ruled as it did, that the current stay should remain until after the second decision of the Panel has been made. The School and ABA are in agreement that the stay in place is appropriate as a result of the ongoing process. RESPECTFULLY submitted this 12th day of July, 2012.
