ORDER: Plaintiff's application to proceed in forma pauperis is granted. Plaintiff is assessed the civil filing fee of $350. The custodian of the pltf's inmate trust account at the institution where he now resides is directed to submit to the Clerk of Court, payments as outlined in this order. In accordance with the Memorandum contemporaneously entered, the complaint fails to state a claim upon which relief can be granted. Pltf's Motion for Preliminary Injunction is denied and this action is dismissed. Entry of this order shall constitute the judgment in this action. Signed by District Judge Aleta A.
