The Report and Recommendation is therefore ACCEPTED and made the findings of fact and conclusions o f law of this court. For the reasons expressed therein, it is hereby ORDERED that the Motion to Dismiss Or, in The Alternative, For Summary Judgement filed by defendant Floyd Sealy (Docket No. 35 ) and the Motion For Summary Judgment filed by defen dant George Enoch (Docket No. 40 ) are GRANTED, and all claims in this case are DISMISSED WITH PREJUDICE.
