ORDER: Plaintiff's application to proceed as a pauper 2 is GRANTED. The individual-capacity claim against Defendant Jimmy Brown, however is DISMISSED for failure to state a claim for which relief may be granted, and the official-capacity cl aims against the remaining defendants are DISMISSED as redundant of the official-capacity claim against Sheriff Brown. Plaintiff's motion for the appointment of counsel 3 is DENIED, but without prejudice to his ability to raise the issue a gain at a later date if circumstances warrant.
