ORDER: For the reasons expressed in the accompanying Memorandum, Defts' Motion for Summary Judgment is GRANTED in part and DENIED in part, Pltfs' Rule 59(e) Motion to Alter or Amend is GRANTED, and Pltfs' Motion for Reconsideration of Order of 10/3/08, and Daubert Motion is DENIED. The claims remaining for trial include the pltfs' excessive force claims against Deputies Wojnarek and Wall and all of the pltfs' state law claims, with the exception of the negligence claim against Montgomery County, over which this court declines to exercise supplemental jurisdiction.
