QUATTLEBAUM; ) MARSHA DYONNE TYLER; VARIOUS ) JOHN DOES; VARIOUS JANE DOES; ) and VARIOUS XYZ CORPORATIONS ) TAYLOR SWIFT No. 3-09-0442 ORDER The motion of defendant Brendan Schiff1 to extend the time for him to file a response to the complaint (Docket Entry No. 46) is GRANTED.2 The time for defendant Schiff to file a response to the complaint is extended to August 19, 2009. In support of his motion, defendant Schiff attaches the declaration of Adam Jay Jaffe, Esq., who, inter alia, suggests that this action is under seal because of the plaintiff's notoriety. The case is sealed in accord with the order entered July 17, 2009 (Docket Entry No. 33), granting the plaintiff's motion for preliminary injunction, pursuant to 15 U.S.C. § 1116(d)(8), which provides that the order, "together with the supporting documents, shall be sealed until the person against whom the order is directed has an opportunity to contest such order, except that any person against whom such order is issued shall have access to such order and supporting documents after the seizure has been carried out." Brendan Schiff is not yet listed as a defendant in this action, since the plaintiff has until September 14, 2009, to file an amended complaint naming as additional defendants those persons who have been served with the complaint, summons and preliminary injunction order and/or that the plaintiff has otherwise identified. Brendan Schiff was served with the summons, complaint, and preliminary injunction on June 26, 2009. See Docket Entry No. 39. 2 1 Defendant Schiff indicates that the plaintiff has no objection to the motion. Dockets.Justia.com Therefore, defendant Schiff is entitled to copies of all documents in this case. However, since the case is sealed, defendant Schiff is correct that neither he nor counsel assisting him can access the electronically filed orders and filings. Therefore, plaintiff's counsel shall provide defendant Schiff or counsel assisting him with copies of any or all filings made in this case, upon his request. The Clerk is directed to mail a copy of this order to defendant Schiff at the address listed on the docket and a courtesy copy to Adam Jay Jaffe, Esq., P.O.
