ORDER: Pending before the Court is Plaintiff Charles E. Cook's ("Plaintiff's") Motion to Consolidate Cases 3:09-cv-00649 and 3:10-cv-00643 ("Plaintiff's Motion") 29 . Plaintiff's Motion is DENIED. Also pendin g before the Court is Defendant's Motion to Dismiss or, in the alternative, for Summary Judgment ("Defendant's Motion") 14 with supporting Memorandum 15 and Statement of Facts 16 . The Court subsequently ordered Defendant 9;s Motion converted to a Motion for Summary Judgment and ordered additional briefing 26 , also allowing Plaintiff to file an Affidavit 24 -1. Defendant subsequently filed two more Replies 27 & 28 . For the reasons stated herein, the Court hereby GRANTS Defendant's Motion for Summary Judgment. Signed by Senior Judge John T.
