ORDER: Clerk will File the complaint in forma pauperis. Plaintiff is assessed the civil filing fee of $350.00. Custodian of plaintiff's inmate trust account at the institution where he resides is directed to submit to the Clerk of Court an initial partial payment according to the terms outlined in this order. As provided in the accompanying memorandum, the plaintiff's § 1983 claims are DISMISSED for failure to state claims on which relief may be granted. The Court having decl ined to exercise supplemental jurisdiction over the plaintiff's remaining state law claims, those claims are DISMISSED without prejudice. Because an appeal would NOT be taken in good faith, the plaintiff is NOT certified to pursue an appeal from this judgment in forma pauperis. Entry of this Order shall constitute the judgment in this action. Signed by District Judge William J. Haynes, Jr on 5/27/10.
