Based upon the Stipulation of Dismissal With Prejudice filed by the parties
pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii) and the signature of counsel below, it appears to the
Court that this action should be dismissed with prejudice. It is, accordingly, hereby ORDERED
as follows:
1.

All pending motions are denied as MOOT.

2.

This action is hereby DISMISSED WITH PREJUDICE.

3.

The Court’s prior December 8, 2011 Order, Dkt. No. 61, dismissing the

case without prejudice is hereby replaced by his final judgment dismissing the case with
prejudice.
4.

All parties shall bear their own court costs.

5.

This Order shall constitute the final judgment of this Court.
