ORDER: The Court finds that the ALJ's failure to give controlling weight to Dr. Asta's opinion was not supported by substantial evidence in the record and was not harmless error. Accordingly, Johnson's Motion (Doc. No. 12) is GRANTE D in part, the Magistrate Judge's Report (Doc. No. 20 ) is ADOPTED in part, the ALJ's determination is VACATED, and this case is REMANDED to the Social Security Administration for a reassessment of the materiality of Johnson's history of substance abuse and further adjudication of his claim for disability benefits.
