ORDER: For the reasons stated above, the Court ADOPTS the Magistrate Judge's Report in part and REJECTS the Magistrate Judge's Report in part. The Court GRANTS Plaintiffs Motion in part, VACATES the administrative determination, and REMANDS this matter to the Commissioner for further proceedings consistent with this Order. The Commissioner's Motion for a Stay Because of Lapse of Appropriations (Doc. No. 27 ) is hereby TERMINATED AS MOOT. The Clerk of the Court is DIRECTED to close this case.
