ORDER ADOPTING REPORT AND RECOMMENDATION: The Court finds substantial evidence in the record supported ALJ Shaughnessy's decision and therefore ADOPTS the Report (Doc. No. 40 ) in its entirety. Plaintiff's Motion (Doc. No. 26 ) is DENIE D and the decision of the Commissioner is AFFIRMED. The case is hereby DISMISSED. By this Order, the Commissioner's pending Motion for a Stay Because of Lapse of Appropriations (Doc. No. 48 ) and Plaintiff's Motion for Abeyance (Doc. N o. 49 ) are TERMINATED AS MOOT.
