ORDER: For the reasons set forth in the accompanying Memorandum, the Objections (Doc. No. 57 ) are OVERRULED. The court ACCEPTS the recommendation that the Motion for Summary Judgment be granted, albeit for slightly different reasons. The Motion for Summary Judgment (Doc.
