ORDER - Within seven days of this order, the plaintiff shall submit a protective order that contains the following text in paragraphs 6a and 8a: Outside litigation counsel of record and supporting personnel employed in the law firm(s) of outside litigation counsel of record, such as attorneys, paralegals, legal translators, legal secretaries, legal clerks and shorthand reporters (With the exception that such information shall not be available to David Pridham, employees of the Law Office of David Pridham and employees under David Pridhams direction or control without express permission of the Court). UNITED STATES DISTRICT COURT EASTERN DISTRICT OF TEXAS MARSHALL DIVISION BRIGHT RESPONSE, LLC vs. GOOGLE, INC., ET AL. § § § § § ORDER Pending before the court are the plaintiff Bright Response, LLC's motion for entry of amended protective order (Dkt. No. 356) and the defendant Yahoo! Inc.'s motion for entry of amended protective order (Dkt. No. 357). These motions stem from the court's June 2, 2010 order excluding Mr. Pridham's access to confidential information. The parties disagree on whether Mr. Pridham may view (1) documents pre-dating the June 2, 2010 order; and (2) financial documents. Mr. Pridham is excluded from viewing any of the defendant's confidential information designated for outside counsel only, including properly designated financial information. Within fourteen days of this order, Mr. Pridham must turn over any such documents already in his possession to outside counsel. This order does not have any retroactive effect, i.e., Mr. Pridham is not in violation of this court's order because he previously possessed and viewed Yahoo's confidential information. He is also not in violation of the order if he uses information previously learned during the prosecution of this case to further prosecute this case.
