UNITED STATES DISTRICT COURT EASTERN DISTRICT OF TEXAS MARSHALL DIVISION BRIGHT RESPONSE, LLC vs. GOOGLE INC., ET AL. § § § § § ORDER CASE NO. 2:07-CV-371-CE Pending before the court are the defendant Yahoo! Inc.'s motion to exclude (Dkt. No. 485) and the defendant Google, Inc.'s motion to exclude (Dkt. No. 505) the testimony and opinions of the plaintiff Bright Response, LLC's damages expert, Stephen Becker. The defendants' motions are GRANTED in part and DENIED in part. The court sustains Yahoo's objection to the application of the Google-Stanford license in calculating damages against Yahoo. The remainder of the defendants' objections are denied; these objections go to the weight, not admissibility of Mr. Becker's opinions and may be addressed through cross-examination.
