The attorneys announced ready for hearing. The purpose of the hearing was to discuss both the necessity and scheduling of any hearings on inequitable conduct. The Court will stay and administratively close the case pending a ruling by the Federal Circuit regarding the Therasense case, which may change the legal standard of inequitable conduct. Once the decision is handed down, the Court will reinstate the case and will take up any disputes regarding subject matter jurisdiction at that time. Application for costs or fees will be due 14 days after the Court lifts the stay. Court adjourned. Dockets.Justia.com
