ORDER OF DISMISSAL On this day came to be considered the Joint Motion to Dismiss filed by Plaintiff Beneficial Innovations, Inc. ("Beneficial") and Defendants Google Inc. ("Google"), YouTube, LLC ("YouTube"), and NBC Universal, Inc. ("NBC Universal") and the Court being of the opinion that the same should be granted, it is therefore, ORDERED, ADJUDGED, AND DECREED, that the Joint Motion to Dismiss is GRANTED and Beneficial's claims against Google, YouTube, and NBC Universal are hereby 1 CASE NO. 2:09-cv-175 (TJW) Jury Trial Demanded dismissed with prejudice, and Google's, YouTube's, and NBC Universal's counterclaims against Beneficial are hereby dismissed without prejudice. Each party shall bear its own costs, expenses and attorneys' fees. 2
