NOTICE REGARDING COUNSEL AVAILABILITY
Plaintiffs Rockstar Consortium US LP (“Rockstar”) and NetStar Technologies LLC
(“NetStar”) regretfully inform the Court that the undersigned lead counsel Max Tribble is in trial
before Judge Lucy Koh of the Northern District of California in the matter of GPNE Corp. v.
Apple Inc., 5:12-ccv-02885-LHK. Plaintiffs respectfully request that Mr. Tribble be excused
from the October 9, 2014 hearing set by this Court via Dkt. 166. Other counsel are available and
will attend on behalf of Plaintiffs. In particular, Justin Nelson is available to attend and, for
purposes of the hearing, serve as lead counsel for Plaintiffs. Both Mr. Tribble and Mr. Nelson
attended the meet-and-confer this Court Ordered via Dkt. 166.
