merit, and after a de novo review, the Report and Recommendation is ADOPTED. Defendants’
Joint Motion to Dismiss for Failure to State a Claim (Dkt. No. 35) and Defendants’ Motion for
Reconsideration (Dkt. No. 68) are hereby DENIED.
