Mirror Worlds, LLC v. Apple, Inc. Doc. 155 IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF TEXAS TYLER DIVISION MIRROR WORLDS, LLC, Plaintiff, v. APPLE INC., Defendant. Civil Action No. 6:08-CV-88 LED JURY TRIAL DEMANDED APPLE INC., Counterclaim Plaintiff, v. MIRROR WORLDS LLC, MIRROR WORLDS TECHNOLOGIES, INC., Counterclaim Defendants. JOINT MOTION TO AMEND THE DOCKET CONTROL ORDER TO EXTEND CLAIM CONSTRUCTION DEADLINES Apple Inc. ("Apple"), Mirror Worlds, LLC ("Mirror Worlds"), and Mirror Worlds Technologies, Inc. ("MWT") hereby move to extend the parties' deadline to complete claim construction discovery, and to comply with P.R. 4.5(b) and 4.5(c). Good cause exists for the requested relief. Due to the winter storm that shut down the airports along the East Coast this past weekend, the deposition of Apple's expert scheduled for December 21 had to be postponed. The parties have met and conferred about rescheduling that deposition in light of the holidays, and Dockets.Justia.com jointly request the following extensions of time in order to allow Mirror Worlds and MWT to take that deposition on January 7, 2010 and complete the claim construction briefing after that deposition has occurred. DCO Entry discovery deadline--claim construction issues (for the limited purpose of completing the deposition of Dr. Feiner regarding claim construction) deadline to comply with P.R. 4-5(b) deadline to comply with P.R. 4-5(c) Current Due Date December 21, 2009 [D.I. 148] Requested Due Date January 7, 2010 December 22, 2009 [D.I. 148] January 15, 2010 January 9, 2010 January 19, 2010 This extension is not sought for the purpose of delay, but instead so that justice may be served. WHEREFORE, PREMISES CONSIDERED, the parties respectfully request the Court to grant their motion to amend the docket control order as set forth herein above.
