Parties announced ready. (SEE SIGN-IN SHEETS) Court inquired of the parties if they had anything to bring up before the Court prior to jury selection. Mr. Carroll responded and the plaintiff has nothing. Mr. Randall responded and the defendant has nothing. Court advised the parties that the Mirror Worlds' panel would be in at 11:00 a.m. Court will begin until 12:30 to begin jury selection. VD ­ 30 minutes per side. Court will give other times later. 9:30 am 12:35 am Court in recess. Jury Panel seated in the Courtroom. Case called. Mr. Carroll announced ready for plaintiff, Mirror Worlds. announced ready for defendant, Apple. Mr. Randall ADJOURN: Court addressed the Jury Panel and welcomed them to jury service. Court addressed the Panel and gave them some preliminary information and instructions. Court advised the jury of the schedule of trial, and the 8 selected will come back on September 20th or possibly September 27. Court gave the parties an overview. DAVID J. Court asked parties to introduce self, co-counsel, corporate representatives, and witnesses. Mr. Carroll introduced self, patent owner and inventor, Dr. David Gelernter, and co-counsel. Court inquired of panel if they know any of these individuals. No responses. Mr. Randall introduced self, co-counsel and corporate representatives, Lisa Marie Schull and Maurine Krall. Court inquired of panel if they know any of these individuals. No responses. Mr. Carroll conducted voir dire on behalf of Mirror Worlds. Mr. Randall conducted voir dire on behalf of Apple. Court addressed the panel and completed voir dire. Juror #6 addressed the Court. Juror #21 addressed the Court. Court addressed the panel and will recess them until 2:25 pm. Mr. Carroll asked to approach the bench. Bench Conference held. Court addressed the panel and recessed them until 2:30 pm. Court addressed the parties. Mr. Carroll addressed the Court and challenged #4 due to answer of question #8 on questionnaire. Mr. Randall responded. Mr. Carroll addressed the Court and challenged #6 due to her concerns of the Patent Office. Mr. Randall responded. Court grants plaintiff's challenge on #4 and denies challenge on #6. Court advised parties that Juror #2 approached Court Security Officer outside the courtroom and she has medical issues with family. Mr. Carroll agrees and Mr. Randall agrees to excuse Juror #2 for cause. Court excused Juror #2 by agreement. Court will allow 6 strikes and will strike through 22. 2:13 pm 2:35 pm Court in recess until 2:30 pm. Court asked clerk to read the names of the 8 jurors selected. Names called and jury seated in the jury box. Court addressed the remaining panel and thanked them for their service. Court excused the remaining panel. Court asked Jury to stand and be sworn. Oath administered to Jury by the Clerk. Court addressed the panel and gave them some preliminary instructions. Court addressed the panel and will excuse them until September 20, 2010 or September 27th, depending on the case before this one. Court advised panel to check the 1-800 number for updates on the case. Court addressed the parties on mediation. Mr. Carroll responded and Mr. Patterson is in contact with the parties. Mr. Randall responded. Court encouraged both sides to continue visiting with mediator. PAGE 3 - Proceedings Continued TIME: MINUTES: Court inquired as to other matters. Mr. Randall responded as to the stipulation and the reduction of claims. Mr. Carroll responded. 2:50 pm There being nothing further, Court adjourned.
