Having considered the parties' submissions, the Court GRANTS in part and DENIES in part Defendants' motion. As the Softlayer Defendants are in no way prejudiced by the deadlines under the current Docket Control Order (Docket No. 174, Softlayer), including the Markman hearing scheduled for October 7, 2010, the Court DENIES the motion as to the Softlayer Defendants. CASE NO. 609 CV 269 PATENT CASE CASE NO. 6:09-CV-549 PATENT CASE Dockets.Justia.com However, in light of Bedrock's Amended Answer and Third Party Complaint (Docket No. 30, Red Hat), filed on March 26, 2010 and asserting crossclaims against fourteen additional defendants, the Court GRANTS the motion as to the Red Hat Defendants. The Court hereby continues the Markman hearing in the Red Hat action to March 10, 2011 at 9:30 a.m. The Court ORDERS the parties in the Red Hat action to meet and confer and submit an agreed Amended Docket Control Order with a revised schedule of deadlines by July 6, 2010.
