The issue described in AOL's Motion for Summary Judgment of Noninfringement is already before the Court in Defendants' Letter Brief Requesting Permission to File Motion to Exclude Capability Testimony of Dr. Mark Jones (Doc. No. 484) and Defendants' Joint Motion for Summary Judgment of Non-Infringement (Doc. No. 463). Therefore, the Court sees no need for another motion on the issue. Accordingly, AOL's Motion for Leave to File a Motion of Summary Judgment of Noninfringement is DENIED; the Motion for Summary Judgment of Noninfringment is DENIED 1 Dockets.Justia.com . as MOOT; the Motion for Leave to Exceed Page Limitations is DENIED; and the Motion to Expedite Briefing is DENIED as MOOT.
