Before the Court are two motions for separate trial (Docket Nos. 1133 & 1134) and
Yahoo!’s Unopposed Motion for Expedited Briefing and Hearing on Yahoo!’s Motion for
Separate Trial (Docket No. 1135). Yahoo!’s Unopposed Motion for Expedited Briefing and
Hearing on Yahoo!’s Motion for Separate Trial is GRANTED in PART and DENIED in
PART. The Court ORDERS that briefing on the two motions for separate trial proceed
according to the following schedule:
Response due: Wednesday, December 21, 2011;
Reply due: Tuesday, December 27, 2011; and
Surreply due: Tuesday, January 3, 2012.
All parties in this case are further ORDERED to meet and confer in an effort to arrive at a joint,
proposed trial plan and schedule. The parties shall submit their joint, proposed trial plan and
schedule to the Court by January 4, 2012. If the parties are unable to arrive at a consensus, they
shall file a status update regarding the parties’ relative positions on a trial plan by January 4,
2012.
