NOTICE OF SETTLEMENT

Responsive to the Court’s Order concerning the pending invalidity trial [Docket No.
1311], Defendant Citigroup Inc. and Plaintiffs Eolas Technologies, Inc. and The Regents of the
University of California (collectively as “the Parties”) hereby jointly and respectfully notify the
Court that Settlement Agreements have been reached between the Parties. Given the timing of
the agreements and the travel obligations of certain of the Parties, the Settlement Agreements are
expected to be fully executed on Monday, February 6, 2012. Full and final dismissal papers
among the Parties will be filed with the Court forthwith.
