ORDER As stated at the hearing on August 31, 2010, the Court DENIES Adobe's alternative motion to strike Eolas's infringement contentions (Docket No. 367). Adobe may serve Eolas with five interrogatories, and Eolas shall respond within 30 days. Further, as stated in the Docket Control Order and at the hearing, the Court APPOINTS former Magistrate Judge Faulkner as mediator in this case, with the first round of mediation to be held before the Markman hearing. So ORDERED and SIGNED this 1st day of September, 2010.
