PLAINTIFFS’ NOTICE OF UNITED STATES PATENT OFFICE’S
NOTICE OF INTENT TO ISSUE EX PARTE REEXAMINATION CERTIFICATE
FOR PATENT-IN-SUIT
Currently pending before the Court are two motions to stay pending the outcome of
reexamination of the patent-in-suit. See Uniloc USA, Inc., et al. v. Disk Doctors Labs, Inc. et al.,
Case No. 6:10-cv-471 (Dkt. No. 122); Uniloc USA, Inc. et al. v. Engrasp, Inc. et al., Case No.
6:10-cv-591 (Dkt. No. 117). On August 5, 2011, the United States Patent Office issued a Notice
2
of Intent to Issue Ex Parte Reexamination Certificate in those reexamination proceedings. A
copy of the Patent Office’s notice is attached as Exhibit A.
As set forth in the notice, the Patent Office has confirmed all claims of the patent-in-suit
over the prior art. With the re-examination now concluded, Plaintiffs contend that both motions
to stay pending re-examination should be denied as moot.
