UNOPPOSED MOTION TO APPROVE THE JOINT STIPULATION TO ADDRESS
ISSUES IN MARKMAN PROCEEDING AND TO WITHDRAW DOCKET NO. 249
WHEREAS issues regarding alleged prosecution history disclaimers arose subsequent to
all prior claim construction proceedings and the Defendants seek to address such issues in
connection with the upcoming Markman proceedings; and
WHEREAS the parties agree to address these issues in the context of the upcoming
Markman proceedings;
It is HEREBY STIPULATED that the parties shall, and the parties hereby do, jointly
request that the Court enter the attached Order confirming that the issues relating to the alleged

disclaimers as set forth in the Joint Local Rule 4-3 submission shall be addressed in the
upcoming Markman proceedings and that, upon entry of the attached Order by the Court,
Defendants shall, and hereby do, withdraw their motion for leave to address such issues during
the upcoming proceedings (Dkt. No. 249.).
