JOINT NOTICE OF TIME REQUIRED FOR MARKMAN HEARING
Pursuant to the Docket Control Order (Dkt. No. 99) entered in this case, the parties
hereby file with the Court this Joint Notice of the amount of time requested for the Markman
hearing in this case, which is scheduled for April 26, 2012, before the Honorable Judge Davis.
In the Joint Claim Construction Statement (Dkt. No. 150) previously filed in this case, the parties
had estimated that they would need a total of three hours for this Markman hearing.
Plaintiff’s Position
In light of the briefing submitted during the claim construction process, however,
Plaintiff now believes that only two hours will be required for the Markman hearing. This
amount of time would allow each side one hour to argue the disputed claims terms and clauses in
this case.

Defendants’ Position
Defendants continue to believe that three hours is an appropriate amount of time for the
Markman hearing in this case. This case involves four patents asserted against four defendants.
There are ten separate terms and clauses in dispute, and Defendants have filed a motion for
summary judgment of indefiniteness for certain means-plus-function terms. While Defendants
will endeavor to make their presentations as succinct as possible, given the complexity of the
case and subject matter, Defendants do not believe that Plaintiff’s proposed two-hour hearing
will provide sufficient time to fully address the constructions, including any questions that the
Court may have as well as arguments Plaintiff may make in its Reply brief. Accordingly,
Defendants request that the Court schedule the Markman hearing for a total of three hours, with
ninety minutes allocated to Plaintiff and ninety minutes allocated to Defendants, collectively.
