UNOPPOSED MOTION TO AMEND DOCKET CONTROL ORDER
Defendant Alcatel-Lucent USA Inc. (“Alcatel-Lucent”) hereby files its Unopposed
Motion to Amend Docket Control Order.

Plaintiff Wi-LAN Inc. (“Wi-LAN”) does not

oppose this motion.
Alcatel-Lucent and Wi-LAN have jointly agreed to amend the Docket Control Order
(Dkt. No. 99, as amended by Dkt. Nos. 216, 226, 232, 238, and 242) to extend the date for
Alcatel-Lucent’s responsive expert report(s) concerning damages to November 9, 2012.
Alcatel-Lucent and Wi-LAN have further agreed to extend the date for the deposition of
Alcatel-Lucent’s damages expert(s) to December 7, 2012, subject to witness availability.
The proposed modifications are necessary to allow sufficient time for completion of
expert reports in light of issues and delays caused by the recent hurricane in the northeast and
to permit completion of expert discovery following service of expert reports. With the
exception of the dates above, all other dates currently specified by the Docket Control Order
would remain unchanged, with the relevant pre-trial and trial dates unaffected. Accordingly,
Alcatel-Lucent respectfully requests that the Court enter the attached proposed Order
effecting the above modifications.

ORDER GRANTING UNOPPOSED MOTION
TO AMEND DOCKET CONTROL ORDER
Before the Court is the Unopposed Motion to Amend Docket Control Order. Having
considered the Motion and for good cause appearing, the Court is of the opinion that the Motion
should be granted. It is therefore ORDERED that the Docket Control Order (Dkt. No. 99, as
amended by Dkt. Nos. 216, 226, 232, 238, and 242) is further amended as follows: (1) AlcatelLucent shall have until November 9, 2012, to serve its responsive expert report(s)
concerning damages and (2) Wi-LAN shall have until December 7, 2012, for the deposition
