CONSENT MOTION OF LATHAM & WATKINS LLP TO WITHDRAW AS COUNSEL FOR NINTENDO OF AMERICA INC. TO THE HONORABLE JUDGE OF SAID COURT: Sabrina Y. Hassan of Latham & Watkins LLP hereby moves this Court for an Order granting leave to withdraw as counsel for Nintendo of America Inc. ("Nintendo"). James S. Blank, who has previously appeared on behalf of Nintendo, recently departed from the law firm of Latham & Watkins LLP to accept a partnership role in the law firm of Kaye Scholer LLP. As James S. Blank continues to represent Nintendo at Kaye Scholer LLP, the requested withdrawal of Sabrina Y. Hassan of Latham & Watkins LLP will not affect the continuity of Nintendo's representation or the administration of this case, nor will it cause any prejudice to either party. WHEREFORE, Sabrina Y. Hassan of Latham & Watkins LLP respectfully requests that this Court grant the Consent Motion of Latham & Watkins LLP to Withdraw as Counsel for Nintendo of America Inc. Dated: July 9, 2008
