IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF TEXAS LUFKIN DIVISION ANASCAPE, LTD., Plaintiff, v. NINTENDO OF AMERICA, INC., Defendant. § § § § § § § § § ORDER In an opinion dated April 13, 2010, the Federal Circuit reversed this court's judgment that several of Defendant Nintendo of America, Inc.'s game controllers infringed certain claims of United States Patent No, 6,906,700, on the grounds that the `700 patent was invalid. Anascape, Ltd. v. Nintendo of America, Inc., 601 F.3d 1333 (Fed. Cir. 2010). In light of this opinion and the representations made on the record by counsel at the June 17, 2010 telephone hearing, Safeco Insurance Company of America is released from holding Supersedeas Bond No. 6590291 and Royalty Payment Bond No. 6590292 on behalf of Nintendo. As discussed at the hearing, the court will not vacate the July 23, 2008 permanent injunction at this time. The injunction will remain in place, and it will remain stayed, pending further order of this court.
