ORDER. It is ORDERED that the findings and conclusions in the Report and Recommendation 15 are hereby ADOPTED as the findings and conclusions of the Court. Pursuant to the provisions of 28 U.S.C. §§ 1915A(b)(1) and 1915(e)(2)(B)(ii), an d for the reasons stated in the thorough and well-reasoned Report and Recommendation, Barnett's claims are DISMISSED with prejudice. Alternatively, for the reasons further stated in the Report and Recommendation, Barnett's claims are DISMISSED with prejudice to their being asserted until the Heck v. Humphrey conditions are met.
