Memorandum Order and Opinion For the reasons cited herein: the Clerk of Court is directed to UNFILE the first amended complaint 9 as it did not comply with the Local Rules; the motion to dismiss 5 filed on July 28, 2017 is DENIED as moot; the m otion to remand 18 is DENIED as time-barred and on other jurisdictional grounds; and, the motion to dismiss 16 filed September 18, 2017 is GRANTED and the claims in the complaint therein are DISMISSED with prejudice, except the declaratory judgment claim which is DISMISSED without prejudice.
