More than 120 days have passed since the complaint was filed and this matter was removed, and Plaintiff have not filed a valid return of service as to Defendants Tony Agnone and Howard Shatsky. Pursuant to Rule 4(m), Fed. R. Civ. P., these defendants are subject to dismissal without further notice. The Court hereby puts Plaintiff on notice that Defendants Tony Agnone and Howard Shatsky may be dismissed for failure to file a valid return of service. Accordingly, by June 7, 2007, Plaintiff must file a valid return of service as to Defendants Tony Agnone and Howard Shatsky, or show good cause in writing why service cannot be made, or Defendants Tony Agnone and Howard Shatsky may be dismissed without further notice.
