ORDER ACCEPTING 18 FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: IT IS THEREFORE ORDERED that Defendant Bank of America, N.A.'s ("Defendant") Motion to Dismiss Pursuant to Federal Rule of Civil Pro cedure 12(b)(6) [ECF No. 6 ] ('Motion to Dismiss") is GRANTED IN PART, and Plaintiff Cornell Rivers, Sr.'s ("Plaintiff") claims against Defendant are DISMISSED WITHOUT PREJUDICE at this time. Plaintiff has 30 days from the d ate of this Order to file an amended complaint addressing the deficiencies raised in Defendant's Motion to Dismiss. Should Plaintiff fail to amend his complaint within 30 days, Plaintiff's claims against Defendant will be dismissed WITH PREJUDICE. (Ordered by Judge Barbara M.G. Lynn on 2/23/2016) (sss)

Stickney. The District Court reviewed the Findings, Conclusions and Recommendation for plain error. Finding none, the Court accepts the Findings, Conclusions, and Recommendation of the United States Magistrate Judge. IT IS THEREFORE ORDERED that Defendant Bank of America, N.A.’s (“Defendant”) Motion to Dismiss Pursuant to Federal Rule of Civil Procedure 12(b)(6) [ECF No. 6] (“Motion to Dismiss”) is GRANTED IN PART, and Plaintiff Cornell Rivers, Sr.’s (“Plaintiff”) claims against Defendant are DISMISSED WITHOUT PREJUDICE at this time.
