Order Accepting 32 Findings and Recommendations on Case re: 12 Motion to Dismiss. Defendants' 12 Motion to Dismiss is GRANTED, and the plaintiff's 28 Motion for Judgment on Pleadings is DENIED. The plaintiff's claims are DISMISSED for failure to state a claim upon which relief can be granted. ORDER ACCEPTING FINDINGS AND RECOMMENDATION
OF THE UNITED STATES MAGISTRATE JUDGE
After reviewing all relevant matters of record in this case, including the Findings,
Conclusions, and Recommendation of the United States Magistrate Judge and any
objections thereto, in accordance with 28 U.S.C. § 636(b)(1), the undersigned District
Judge is of the opinion that the Findings and Conclusions of the Magistrate Judge are
correct and they are accepted as the Findings and Conclusions of the Court.
Defendants’ 12(b)(6) Motion to Dismiss, filed June 14, 2017 (doc. 12) is GRANTED,
and the plaintiff’s Motion for Judgment on Pleadings, filed October 25, 2017 (doc. 28) is
DENIED. The plaintiff’s claims are DISMISSED for failure to state a claim upon which
relief can be granted.
By separate judgment, all of the plaintiff’s claims against the
defendants will be DISMISSED with prejudice.
