Order Accepting 32 Findings and Recommendations on Case re: 12 Motion to Dismiss. Defendants' 12 Motion to Dismiss is GRANTED, and the plaintiff's 28 Motion for Judgment on Pleadings is DENIED. The plaintiff's claims are DISMISSED for failure to state a claim upon which relief can be granted. Defendants’ 12(b)(6) Motion to Dismiss, filed June 14, 2017 (doc. 12) is GRANTED, and the plaintiff’s Motion for Judgment on Pleadings, filed October 25, 2017 (doc. 28) is DENIED. The plaintiff’s claims are DISMISSED for failure to state a claim upon which relief can be granted.
