MEMORANDUM OPINION and ORDER granting in part and denying in part 37 Motion for Summary Judgment filed by Robert E. Houchin... defendant's motion for summary judgment be, and is hereby, granted as to plaintiffs' claims ofbreach of fiduci ary duty, fraud, and conversion and that the motion be, and is hereby, denied as to all other claims. The court further ORDERS that plaintiffs' claims for breach of fiduciary duty, fraud, and conversion be, and are hereby, dismissed with prejudice. See Order for further specifics.
