Civil Action No. 4:11-cv-00244-Y
DEFENDANT ORBITZ WORLDWIDE, LLC’S RESPONSE TO PLAINTIFF
AMERICAN AIRLINES INC.’S MOTION FOR RECONSIDERATION OF THE
COURT’S NOVEMBER 21, 2011 ORDER
Defendant Orbitz Worldwide, LLC (“Orbitz”) hereby responds to plaintiff American
Airlines, Inc.’s (“American”) Motion for Reconsideration of the Court’s November 21, 2011
Order (Dec. 19, 2011, Dkt. 162) (“Motion”).
American’s motion purports to request reconsideration of the Court’s dismissal with
prejudice of the fourth, fifth and sixth claims for relief in its First Amended Complaint (the
“FAC”). (Motion at 1.) Orbitz was named in only the FAC’s third and fourth claims for relief,
and American’s motion makes plain that it is not challenging any aspect of the Court’s Order
1
dismissing the fourth claim as it relates to Orbitz. Accordingly, Orbitz requests that any ruling
by this Court on American’s motion make clear that the November 21, 2011 Order Regarding
Motions to Dismiss and Motion for Leave (Dkt. 156) remains unchanged with respect to Orbitz.
