JOINT REPORT REGARDING SETTLEMENT CONFERENCE SUBMITTED BY
PLAINTIFF AMERICAN AIRLINES AND TRAVELPORT DEFENDANTS
Pursuant to the Court’s August 1, 2011 Initial Scheduling Order, plaintiff
American Airlines, Inc. and defendants Travelport, LP and Travelport Limited (together,
“Travelport”) jointly submit this report regarding their recent settlement conference.
An in-person settlement conference between American and Travelport was held
on January 27, 2012. The business representatives that participated on behalf of American were
Bridget Blaise-Shamai, Managing Director of Distribution Strategy; and Cory Garner, Director
of Distribution Strategy. The attorneys that participated on behalf of American were Bruce
Wark, Associate General Counsel; Paul Yetter of Yetter Coleman LLP; and MJ Moltenbrey of
Dewey & LeBoeuf LLP. The business representatives that participated on behalf of Travelport
were Kurt Ekert, Chief Commercial Officer; and Dan Westbrook, Vice President, Supplier
Development. The attorneys that participated on behalf of Travelport were Tom DeMay, Vice
President of Legal, Travelport Americas; and Michael Weiner of Dechert LLP.
The parties engaged in good faith, productive discussions about general
principles. Because this lawsuit involves a complex contractual relationship between the parties
and disagreements about ongoing conduct, the parties shared their views on the parameters of
their business relationship going forward. They discussed their views of the claims that both
sides have filed in this lawsuit. No meaningful progress towards settlement was made, however,
and no agreement was reached.
Based on the parties’ discussions, the prospects for settlement at this time are low.
The parties did agree to consider hiring a mediator in this case.
