ORDER GRANTING MOTION FOR PROTECTIVE ORDER
Pending before the Court is the Motion for Protective Order (doc.
406) filed by third-party Hewlett Packard Company ("HP") on September
5, 2012.
In the motion, HP requests that it be protected from
responding to a subpoena duces tecum served on it by defendant
Travelport, Ltd. and Travelport, LP (collectively, "Travelport") on
August 10, in part due to the fact that the parties had requested
a stay of all proceedings in this case pending mediation.
On
September 6, the requested stay was granted, staying all claims herein
until December 21, 2012. As a result, the Court concludes that the
motion for protective order should be and hereby is GRANTED, in that
HP need not produce documents responsive to Travelport's subpoena
duces tecum until a mutually convenient date and time prior to January
18, 2013, in the offices of HP's attorney, Tim Gavin, Carrington,
Coleman, Sloman & Blumenthal, L.L.P., 901 Main Street, Suite 5500,
Dallas, Texas 75202, assuming a settlement is not reached during
mediation.
Furthermore, assuming mediation is not successful, counsel for
HP and Travelport should again confer at a mutually agreeable date
and time between December 22 and January 4, 2013, in an attempt to

reach a resolution of HP's objections regarding protecting its
proprietary information regarding the Jetstream project. Should they
again be unable to reach an agreement, HP may file another motion
for protective order prior to the January 18 production deadline.
