(“American”) with respect to its Motion to Compel Production of Documents Improperly Clawed Back By Orbitz Under Claim of Privilege filed on January 29, 2013 [Dkt. 425] (the “Motion”), which was referred to your Honor on February 5, 2013 [Dkt. 432]. This afternoon, Orbitz informed counsel for American that it has withdrawn its privilege claims as to the documents at issue in the Motion and re-produced those documents for use in this litigation.
