ORDER ACCEPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE: The undersigned District Judge is of the opinion that the Findings and Conclusions of the Magistrate Judge are correct, and they are accepted as the Findings and Conclusions of the Court. Accordingly, it is ORDERED that Defendant's Motion to Dismiss (ECF No. 25 ) is GRANTED. This case is therefore DISMISSED without prejudice. (Ordered by Judge Reed C. O'Connor on 3/15/2018) (plp)

Accordingly, it is ORDERED that Defendant’s Motion to Dismiss (ECF No. 25) is GRANTED. This case is therefore DISMISSED without prejudice.
