ORDER: ADOPTING 69 Findings and Recommendations. Plaintiff's 71 objections should be overruled in all things. Defendant's 45 Motion for Summary Judgment is GRANTED. All relief not expressly granted and all pending motions should be d enied. Judgment shall be entered accordingly. Plaintiff is advised that if he appeals this Order, he will be required to pay the appeal fee of $455.00 pursuant to the PLRA, and must submit an application to proceed in forma pauperis and a 6-month Certificate of Inmate Trust Acct. at the time he files a NOA.
