ORDER: It is ORDERED; (1) Defendant Marciela Garza's 14 Motion to Dismiss for Failure to State a Claim is DENIED. (2) Defendant Marciela Garza shall file a written answer within thirty (30) days from the date of this Order. (3) Defendant Chris topher Sanchez is dismissed without prejudice. (4) Plaintiff Martinez's "motions" filed on October 14 re sealed motion 41 , November 17 re 45 Motion/TRO, and December 22, 2014 re sealed motion 50 , are denied in all things. (5) All discovery is stayed until further order of this Court. The Magistrate Judge's recommendation to deny Defendant Garza's Motion to Dismiss should be ADOPTED.
