MEMORANDUM OPINION and ORDER granting in part and denying in part 19 Motion to Dismiss. As such, the Court DENIES with prejudice Defendant's Motion to Dismiss Plaintiffs' false arrest and false imprisonment claim against Tamez inhis offic ial capacity. Finally, Plaintiff failed to plead the necessary elements of a cause of action against Defendants for civil conspiracy under 42 U.S.C. 1985.
