FINDINGS OF FACT AND CONCLUSIONS OF LAW. IT IS ORDERED that all of Defendant Vey Finance, LLC's counterclaims are dismissed with prejudice, except its claims for equitable subordination and determination of the validity, extent, and priority of liens, which are dismissed without prejudice so that the bankruptcy court may consider those issues. IT IS FURTHER ORDERED that, upon entry of final judgment, the Clerk of the Court shall disburse the funds placed in the Registry of the Court in co nnection with this case, a total of $251,993.38, to Plaintiff Compass Bank.
