On this day, the Court considered Defendant National United Group, LLC's
("National United") "Motion to Dismiss Plaintiff's First Amended Complaint" ("Motion"), filed
in the above-captioned case on July 14, 2021. ECF No. 43. Therein, National United asks the
Court to dismiss Plaintiff Brandon Callier's ("Mr. Callier") First Amended Complaint
("Amended Complaint"), filed on June 24, 2021. ECF No. 33. Mr. Callier alleges that
National United, along with other entities and individuals, violated the Telephone Consumer
Protection Act ("TCPA") and Texas consumer-protection statutes by making repeated phone
calls to Mr. Callier's cellular phone using a robocalling system. See Amend. Compl. 1-3, 8-15,
ECF No. 33. Mr. Callier issued his Response, ECF No. 44, to National United's Motion on
July 19, 2021, and National United issued its Reply, ECF No. 48, on July 27, 2021.
The Court finds that Mr. Callier's allegations are sufficient to raise an inference
that National United may be responsible for violations of the TCPA and the Texas Business and
Commerce Code. However, one of Mr. Callier's claims fails. Accordingly, the Court will
deny the Motion in part and grant the Motion in part.
