ORDER AND MEMORANDUM DECISION GRANTING MOTION FOR SUMMARY JUDGMENT-It is therefore ORDERED that Plaintiff Republic Bank's Motion for Summary Judgment 57 is GRANTED. It is further ORDERED that Republic Bank's Motion for Scheduling Order [ 58] is DENIED as MOOT. The Clerk of the Court is directed to enter judgment in favor of Plaintiff.
